Terms of Service

Agreement to Terms

By downloading, accessing, or using the Garden Helpr mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Albemarle Studio SARL-S, a company registered in Luxembourg ("Garden Helpr," "we," "our," or "us").

Description of Service

Garden Helpr is a plant care application that provides personalised care recommendations, daily check-in prompts, seasonal intelligence, weather-aware guidance, plant identification, and health diagnosis for indoor and outdoor plants. The App is available in a free tier with limited features and a Premium subscription tier with expanded functionality.

User Accounts

To use the App, you need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information when creating your account and to update it if it changes.

You may only create one account per person. If we detect multiple accounts being used to circumvent free-tier limits, we reserve the right to suspend or terminate those accounts.

Free and Premium Tiers

Free Tier

The free tier includes access to core features with the following limits: up to 5 plants, 2 zones, 3 lifetime Plant ID scans, 30 days of care history, and basic seasonal awareness. Free-tier limits are subject to change.

Premium Subscription

Premium removes all limits and adds advanced features including unlimited plants, zones, and scans, AI-powered disease and pest diagnosis, full seasonal intelligence with interactive checklists, care insights dashboard, planting planner, and expert care depth.

Premium is offered at $7.99 USD/month or $56.99 USD/year. Prices may vary by region and are displayed in your local currency in the App Store.

Subscriptions and Payments

Billing

Premium subscriptions are billed through Apple's App Store. By subscribing, you also agree to Apple's terms of service for in-app purchases. We do not process payments directly and never have access to your payment information.

Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your App Store account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions on your device). Cancellation takes effect at the end of your current billing period — you retain access to Premium features until that date. We do not offer refunds for partial billing periods. For refund requests, contact Apple Support directly.

Price Changes

We may change subscription prices from time to time. Price changes will not affect your current billing period. You will be notified of any price increase before your next renewal and given the option to cancel.

Free Trials and Promotional Offers

We may offer free trials or promotional pricing from time to time. If a free trial converts to a paid subscription, you will be charged at the standard rate unless you cancel before the trial ends.

User Content

Your Content

You retain ownership of all content you create in the App, including plant photos, observations, notes, and garden data ("User Content"). By using the App, you grant us a limited, non-exclusive licence to use your User Content solely for the purpose of providing and improving the App's services — for example, sending your plant photos to our identification service or storing your care logs in our database.

Content Processing

When you use plant identification or diagnosis features, your photos are sent to third-party services (Kindwise/Plant.id) for processing. By using these features, you consent to this processing. We do not use your photos for advertising, sell them to third parties, or use them to train AI models.

Prohibited Content

You agree not to upload content that is illegal, harmful, threatening, abusive, or that infringes on the rights of others. We reserve the right to remove content that violates these Terms.

Plant Care Guidance and AI-Generated Content

General Guidance Only

Plant care recommendations, identification results, and diagnosis assessments provided by the App are generated using artificial intelligence and environmental data. They are intended as general guidance to support your plant care decisions, not as professional horticultural, agricultural, or botanical advice.

No Guarantees of Accuracy

While we strive to provide accurate and helpful information, we cannot guarantee the accuracy, completeness, or reliability of any AI-generated recommendations, plant identifications, or health assessments. Plant identification results include confidence levels — lower-confidence results should be verified independently.

Your Responsibility

You are responsible for your own plant care decisions. We recommend cross-referencing important care decisions (especially regarding plant toxicity, edibility, or use of chemical treatments) with authoritative sources. Garden Helpr is not liable for any plant damage, loss, injuries or health issues resulting from following recommendations provided by the App.

Acceptable Use

You agree to use the App only for its intended purpose and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorised access to our systems, servers, or other users' accounts
  • Reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality or infrastructure
  • Use automated tools, bots, or scrapers to access the App
  • Circumvent free-tier limits through multiple accounts or other means
  • Upload malicious code, viruses, or harmful content
  • Use the App for commercial purposes (reselling data, bulk identification services, etc.) without our written permission

Intellectual Property

The App, including its design, code, branding, features, content, and documentation, is owned by Albemarle Studio SARL-S and is protected by copyright, trademark, and other intellectual property laws. "Garden Helpr" is a trademark of Albemarle Studio SARL-S.

You may not reproduce, distribute, modify, or create derivative works based on the App or its content without our prior written permission. This does not affect your ownership of your own User Content.

Account Suspension and Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a way that harms other users or our services. We will provide reasonable notice where possible.

You may delete your account at any time by contacting us at support@gardenhelpr.com or through the account settings in the App. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by applicable law, Garden Helpr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of plants, crops, profits, data, or goodwill, arising out of or related to your use of the App.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us for Premium subscriptions in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of weather data, plant identification results, or care recommendations.

Assumption of Risk

Garden Helpr is a digital information tool. Any physical activities you undertake related to plant care — including but not limited to gardening, handling plants or soil, applying treatments, moving heavy pots, working outdoors, or acting on recommendations from the App — are done entirely at your own risk. Garden Helpr is not responsible for any personal injury, property damage, allergic reaction, or harm to people or animals arising from your use of information provided by the App. You acknowledge that plant care involves inherent physical risks and that you are solely responsible for your own safety and the safety of others when acting on any guidance from the App.

Third-Party Services

The App integrates with third-party services to provide its features (as detailed in our Privacy Policy). We are not responsible for the availability, accuracy, or content of these third-party services. Your use of the App is also subject to the terms and policies of Apple's App Store.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email and update the "Last updated" date at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the App and delete your account.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Luxembourg.

If you are a consumer in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence. Nothing in these Terms affects those rights.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
